Interviewing persons who are intoxicated or in a disturbed mental stateThe police are entitled to interview a person who is heavily intoxicated only if this is essential for investigating the offence. If the police interview such a person, a note shall be made in the record of the interview (examination record) as to the person's condition and why the interview was considered necessary. The person interviewed will also be given an opportunity to re-examine his/her statement at a later stage. The same applies to persons who cannot be expected to understand the importance of the interview on account of their disturbed mental state, emotional upset or other similar reason. Where necessary, the police must consult the person's family and physician about the interview. Back | Print page | |
